Terms & Conditions


1. Introduction


These terms and conditions relate to goods which you offer to purchase from the tReds online store ("our/this website"). Please read these terms and conditions, which govern your use of this website and our supply to you of any goods which you offer to purchase through our on-line facilities. We will be unable to process any offer to purchase goods until you have done so. If there is anything you do not understand, please feel free to e-mail us at [email protected], or phone us on 0800 635 0021.

This contract content will be stored by tReds. You may store these terms and readily look them up. For safety reasons, your order data is not available to the general public. We keep this data in confidence according to our privacy policy.

By making an offer to purchase, you agree to be bound by the whole provisions of the Agreement (as defined in clause 3.1 below) between you and us. If you do not accept these provisions you should not place an order. Your attention is drawn in particular to clauses 5 (limitation of liability) and 6 (indemnity).

These terms and conditions may be changed at any time by us and we are not under any obligation to notify you of such changes.


2. Definitions


In these terms and conditions:-

2.1 "Commencement Date" means the date when our agreement with you is concluded (see clause 3.3);
2.2 "Confirmation Form" means the form that is shown on screen after you have placed an order, confirming details of the Goods which you have offered to purchase and which we have agreed to supply to you;
2.3 "Consumer" means an individual whose use of the Service is for personal purposes only, and not for use in connection with any trade, business or profession;
2.4 "Order Form" means the form completed by you online and showing details of the goods which you have offered to purchase from us;
2.5 "Goods" means the goods to be provided by us to you, as described in the Order Form and Confirmation Form and on the pages of our website relevant to those goods. (In the event of a discrepancy between the description of the Goods on the website and that on the Order Form Confirmation Form, the description on the Order Form or Confirmation Form shall be conclusive);
2.6 "We/Us/Our" refers to tReds, a company incorporated in England (registered number 11815602) and having our registered office at 48 Lynch Lane, Weymouth, Dorset, DT4 9DN; and
2.7 "You/Yours" refers to you, the person offering to purchase goods from us.


3. Your Agreement with Us


3.1 These terms and conditions, together with the Order Form, Confirmation Form, Privacy Policy, constitute the entire agreement between you and us relating to the provision of the Goods ("the Agreement"), and supersede any previous agreements, arrangements, undertakings or proposals, written or oral, between us in relation to this, and all past courses of dealing or industry custom. No oral explanation or oral information given by any party (including any information given via our customer service departments) shall alter the interpretation of these terms and conditions. In agreeing to these terms and conditions, you have not relied on any representation other than those expressly stated in these terms and conditions, and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in these terms and conditions.
3.2 Nothing on our website is intended or shall be interpreted to mean that we are making a legal offer to you to provide the Goods; we are inviting you to make a legal offer to us to purchase the Goods. It is entirely at our discretion to accept or reject the offer to purchase.
3.3 The Agreement is concluded only when we have dispatched your order and delivery of the goods have been signed for by the customer.


4. General


Payment can be made using any of the methods listed on this website and will be debited when we have accepted your offer to purchase.

All prices are quoted in UK pounds Sterling and include VAT where applicable.

Our acceptance of your offer to purchase Goods is subject to their availability. Our acknowledgement of order acceptance via web or e-mail is not a guarantee of delivery. We will inform you if we are unable to deliver the Goods which you have offered to purchase and a full refund will be given.

You accept that you are responsible for entering your own data correctly. Billing and delivery address details must be correct when provided, we will deliver to the address you enter. Unfortunately, we will not be liable for any item delivered to the wrong address due to incorrect information provided by the customer, this includes selecting incorrect country.

Every effort has been made to ensure the website shipping details, return details, general information, item descriptions and price of goods are correct. We will inform you as soon as possible in the event of an error in pricing or item description coming to our attention. Where we notify you of such an error, you will have the option of either (i) confirming your offer to purchase subject to the corrected description or price, or (ii) retracting your offer to purchase and receiving a full refund if the Goods have been paid for. We will correct any invalid information on our website within a time frame we deem reasonable after we have been notified of the error.

5. Delivery Details and Returns Policy

5.1 Delivery - UK
  Any delivery dates displayed on our website are to be regarded as estimations. You agree we will not be held accountable for matters outside of our control which may cause delays or failures in receiving your order. Collections and deliveries will not occur during UK Bank and Public holidays.
  All deliveries are subject to stock availability and authorisation of your payment.
  We shall endeavor to deliver the Goods you have offered to purchase within 5 working days after we receive your offer. If there are any delays we will notify you of such delay as soon as possible. Please bear in mind that you may receive items in separate packages at separate dates and times, this is because we ship from multiple locations and it is not always possible to group items together within one package.
  We can either deliver your order to the billing address for the card you use to pay for your order, or you can specify an alternative address such as a workplace, university or friend/family address at checkout.

Delivery is charged at £3.50 (UK mainland only). Delivery outside the UK mainland (Jersey, Guernsey, Isle of Man, Scottish Highlands, Northern Ireland, etc..) may require an extra charge. This charge will be highlighted in the checkout page when you select a delivery address that doesn't qualify for our normal delivery rate.

  Your order may be delivered by Royal Mail Tracked™ to you during office hours (9-5pm), Monday to Saturday. We are unfortunately unable to specify the time at which the goods will be delivered to you.

If ordering to out of area places such as Scottish highlands you are able to specify an alternative secure delivery place called Royal Mail Safeplace™ on your order which will enable the delivery driver, if you are not available, to leave the item in your designated secure area. To add this option to your order simply write a short description into the 'delivery comments' field at checkout. Please note, if you specify a Royal Mail Safeplace™ the liability for that area to be secure is your responsibility, you add this option entirely at your own risk. We will not send any replacements for lost or stolen items that were delivered into your specified Royal Mail Safeplace™.


Your delivery driver will scan the barcode of the package when it is delivered. If there is no one at the time of delivery to sign for the item(s) in your order the driver will attempt a redelivery the following working day. If there is no one at the time of delivery the next day you will be notified and the item will return to tReds where we will arrange a redelivery with you.

If the item is returned back to us due to non-delivery there will be a charge of £5.50 for a re-delivery.

  Delivery - EU
We now deliver outside the UK.

Delivery is £19.99 per item for the following countries: Italy, Spain, Greece and Portugal, Ireland (Republic Of), Belgium, Luxembourg, Netherlands, Denmark, France, Germany, Monaco, Hungary, Lithuania, Poland, Finland, Czech Republic, Austria, Norway, San Marino, Slovakia, Slovenia, Sweden and Switzerland

  Your goods will be shipped via Parcel Force EuroPriority and are trackable online. We endeavour to deliver the goods you have offered to purchase within 7-12 working days from the receipt of your offer.

Customs charges: Any customs or import duties are charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel. We have no control over these charges and can't let you know how much they'll be. Policies vary from country to country so it would be a good idea to check your local customs for more info.

If the item is returned back to us for an exchange or due to non-collection there will be an additional delivery charge for a re-delivery.

  Delivery - Rest of the World
At this moment in time we do not deliver outside the EU.

Reporting delivery issues
Any issues with your delivery must be reported to us within seven days of receiving your item. This includes any damaged or incorrect items that you receive.

5.2 Returns Policy
  We hope you're happy with your new tReds purchase! However, if you're unhappy for any reason, here's what to do.

Changed your mind?
If the shoes are not as you thought they would be or you simply do not like them when you get them, you have 14 days for a refund and up to 365 days to return them to us for an exchange or gift card (these days start from the day you receive the item). You can return your goods to any tReds store, or you can send them back to our returns address along with the completed returns form (which is in the box). Package the shoes securely and post them to: tReds Website Returns, 48 Lynch Lane, Weymouth, Dorset, DT4 9DN, UK. We will ensure that we keep you informed about your return. If you are returning the goods due to a fault, or if we have sent you the wrong order, then we will refund the cost of postage, however, if your goods are being returned because they are unsuitable or the wrong size then you are responsible for the postage cost.

When returning goods to us, all we ask is that you send them back in the original condition and in their original box. Damaged or used goods might not qualify for a full refund due to loss of value. We may compensate up to 100% of the purchase price if you have severely damaged the goods, box, packaging or contents.

There are 3 ways for you to return shoes to us:

At a store
Just go to your nearest tReds store with your shoes and some form of proof of purchase. Proof of purchase can be either the printout of your order confirmation, your e-mail confirmation which was sent to you after you placed your order or your receipt that came with your order.

By post
Pack up the shoes carefully in their original box and a secure outer wrapper and send them back clearly addressed to:

Using the Returns Form which will have been enclosed when you received your order. Enclosing the returns form is not obligatory within the framework of the statutory right to cancel however this will help us to process your return more quickly.

You should get a certificate of posting from the Post Office or alternatively send the item(s) back via special delivery as we need to receive the returned item(s) before we can action your request.

We will either give you an exchange if this is what you want or we will refund your original purchase price. Sorry, but you need to pay the postage to send the parcel back to us via post.

All returns will be processed and completed within 14 days.

We will gladly return any unwanted Christmas presents up until January 14th. All returns must have the original packaging, proof of purchase and be unworn. None of the above affects your statutory rights. We wish all of our customers a very happy Christmas!

Payment may be made by any of the methods above and will be debited when we receive your order. The total amount you pay is the same, regardless of the payment method you use. We do not accept cheques.

Our prices include VAT where applicable.


8. Security & Data Protection


8.1 Data Protection
  We are committed to protecting your privacy and the security of any information given to us in order for us to process your order.
8.2 Our Data Protection Policy
  We will not gather or hold personal information about you unless you have given your express permission for us to do so. By placing an order, you will consent to the use of such personal information.
  Any personal information held or processed will be kept up-to-date and will be destroyed as soon as the reason for its collection or processing has lapsed.
  No personal data about customers will be passed to any third party, except to fulfil the delivery of the goods to you, and as is necessary to process credit or debit card payments.
  Your privacy and confidence will be respected at all times.
8.3 What Information is collected about you and how is it used?
  When you place an order we need to collect your name, address, e-mail and telephone number as well as details of the method by which you intend to pay for the Goods. This information allows us to process your offer to purchase Goods and delivery of those Goods to you. We use your e-mail address to send you notification of the status of the order. We will contact you by e-mail or by telephone if any problems occur regarding delivery of the Goods to you.
  This information may be provided to third party service providers for the purpose of processing your offer to purchase the goods.
  We may use your e-mail address to provide you with information on products, services, promotions and special offers where you have indicated that this is acceptable by checking the box on the 'Delivery details page'.
8.4 Third parties
  We will not sell or pass your details to third party organisations except for the purpose of processing your offer to purchase the goods.
8.5 Consent
  By making an offer to purchase Goods you consent to the information you provide to us being processed for any of the above purposes.
8.6 Cookies

A cookie is a piece of information which a website transfers to the cookie file of the browser on your computer. The browser then saves the information and sends it back to the website server. When that browser returns to the same website the cookie will recognise the user.

A cookie will typically contain details such as the domain from which the cookie has come from, a value which is usually a random unique number as an identifier and the lifetime (expiry) of the cookie.

What will a cookie do for me?

Why do tReds use cookies:
tReds wants to provide a good customer experience on the website and here's an example of how cookies can allow this to happen:
Shopping Experience: To remember the items that you have added to your basket to make the checkout process easier when you return back to the website.
Content: Show you relevant content such as product recommends depending on your browser and buyer behaviour.
User Behaviour: Analytics to track website visits and clicks for pages visited with hourly transaction volume. This allows us to see how our customers like to use our website and which pages or functions they prefer, this allows us to continually improve our service.
Third Party: Selected partner cookies which track where the users visit originated from. This allows us to see where their visit originated from, especially advertising on partner sites or affiliates, present appropriate offers and helps prevent fraud and detect spammers.

Turning off / disallowing/disabling or deleting cookies:
The majority of internet browsers will provide an option to disallow cookies. You can usually find how to do this in the help menu for your browser. Cookies can also be deleted by using your internet browser, but you must disallow otherwise they will be reapplied the next time you visit a website.
8.7 Security
  The security of your transaction is important to us and to prevent any details being seen by unauthorised persons it is protected throughout the payment process. To do this we use a secure server to encrypt the information before it is sent to the payments processor.
8.8 Subject Access Request
  On your written request, we will (within 40 days of such a request being received by us) supply to you details of the personal information which we hold about you. You must explain to us clearly the information you require to be supplied: we are not obliged to supply to you information which is not specifically requested by you.
  Under the terms of the Data Protection Act 1998, we are entitled to charge you £10.00 for the provision of information following our receipt of such a request.
  Once we have received your written request and payment of the fee, we will respond to your request within 40 days.
  You should note that, under certain circumstances, we will not be obliged to disclose the requested information to you, in which case we will explain to you the reasons for our refusal.


9. Distance Selling Regulations


We are obliged by law to provide you, prior to the delivery to you of the goods which you have purchased, with certain information in relation to those goods and your rights in relation to the agreement with us. This information appears throughout these Terms and Conditions but is summarised in the Confirmation Form.


10. Right to Cancel this Agreement


Under the Distance Selling Regulations, you have 14 days from the Commencement Date ("the cooling-off period") in which to cancel this Agreement if for any reason you are not happy with the Goods which have been delivered to you. This cooling off period begins on the day after the day you receive the Goods from us.

If you wish to cancel the Agreement, you must notify us of this fact in writing and send your notification to us by post using the provided returns instructions which you will find with your purchase. Full contact details are set out below.

On cancellation, you must return the Goods that we have delivered to you. On our receipt of the returned Goods, we will exchange the Goods or we will refund to you the price you paid for the Goods. Unless you originally received substitute goods, you will be liable for the costs of returning the Goods to us, and we will not reimburse you for this.

You should return such Goods either to one of our stores or post back to us at the following address:

    • Goods must be adequately sealed in the original packaging. Please note that the Royal Mail may reject any package that is not adequately wrapped;
    • Fully complete the returns form included with the delivery package, this will ensure that you receive your refund or replacement goods promptly;
    • Please make sure that you have addressed the package clearly with the above address. Make sure that you get a certificate of posting from the Post Office as proof that you have sent the package (the Post Office do not charge for issuing these certificates).


11. Limitation of Liability


Nothing in these terms and conditions is intended to exclude any provision of the Unfair Contract Terms Act 1977, or of the Unfair Terms in Consumer Contracts Regulations 1999, or of any other legislation designed to ensure that the rights of parties to a contract of the type of this Agreement (i.e. standard terms and conditions which are not individually negotiated) are fairly balanced.
Subject to the aforesaid, we shall not be liable to you for any loss or damage unless such loss or damage arises as a direct result of our negligence, recklessness or wilful misconduct, or fraud or misrepresentation on our part.
To the fullest extent permitted by applicable law, we disclaim all liability for our employees' or sub-contractors' negligence.
We may include links from time to time from our website to other internet sites. We have no control over the content of such sites and disclaim any liability in respect of your use of such sites.
All conditions, terms, representations and warranties relating to the Goods which are not expressly stated in this Agreement are hereby excluded to the fullest extent permitted by law.
Our total liability to you in respect of any claim by you arising out of or in connection with the provision (or the failure to provide) the Goods shall be limited to the value of the goods supplied.
No claim by you against us shall be valid unless you have notified us of the details of the claim within one year of it arising.
Every provision of this clause 11 excluding or limiting liability shall be construed separately, applying and surviving even if for any reason any of these provisions is held inapplicable or unenforceable in any circumstances, and shall remain in force notwithstanding the expiry or termination of this Agreement.


12. Indemnity



You agree that you shall be liable for, and hereby agree to indemnify us on demand in respect of any and all demands, liabilities, losses, costs and claims (including reasonable legal fees) sustained or incurred by us, our agents, suppliers, resellers, our customers, officers or employees, and arising as a result of breach by you of this Agreement.


13. Website Content


We have used reasonable care and skill in compiling the content of our website but make no warranty, express or implied, as to the nature or accuracy of any material on the website and cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon information contained within the website. The Confirmation Form is conclusive as to the Charges and the description of the Service.

Although every effort is made to ensure complete accuracy, some prices, details and stock shown on the website may change from time to time, and it is possible that errors will occur. We will use reasonable endeavours to rectify any errors as swiftly as possible.

15. Law and Jurisdiction


The Agreement shall be governed by and construed in accordance with English law and you agree to submit to the non-exclusive jurisdiction of the English courts. You are responsible for compliance with any applicable laws of the country from which you access our website.

The contract's content will be stored. You may store the terms and readily look them up. For safety reasons, your order's data are not available via the internet. We keep these data in confidence according to our privacy policy.

15. Sale Exclusions

During promotion and sale period items may be excluded from offers without any prior notification to customers. Prices are sometimes controlled by our suppliers and in such cases we may be asked by them to exclude the item from our offers.
